Your Rights in Chapter 13 Bankruptcy Proceedings

When you file for protection under Chapter 13, your creditors must immediately stop all efforts to collect money from you, including harassing phone call, letters and lawsuits. In a Chapter 13, you work with your creditors to establish new payment arrangements, agreeing to repay some or all of your obligations over a 3 to 5 year period. Almost any debt can be restructured in a Chapter 13 proceeding, including home mortgages, property settlements and taxes. As long as you comply with the terms of your new agreements, your creditors cannot make any additional attempts to collect from you. At the end of the repayment period, your debts are discharged.
